Victim does not or cannot consent, refuses, or is coerced by overt or implied threats of violence; intentional touching either directly or through the clothing, of the genitalia, anus, groin, breasts, inner thigh or buttocks of any person. Excludes contact incidental to a physical altercation with no sexual intent for the assault

Sexual Harassment
Repeated and unwelcome sexual advances, request for sexual favors, or verbal comments directed at another detainee.

Any substantiated incident of sexual abuse or sexual harassment is reviewed by the Minnehaha County Juvenile Detention Center (JDC) review team after the investigation is completed. The review team looks at all factors that may have played a part in the substantiated incident of sexual abuse or harassment.
The review team makes recommendations for improvement in areas ranging from physical building conditions and layout, staffing plans and technology related monitoring and surveillance. The Minnehaha County Juvenile Detention Center has a Zero Tolerance policy for any sexual abuse or harassment. The Prison Rape Elimination Act (PREA) guidelines, steps to reporting sexual abuse or harassment and the steps that JDC has taken to eliminate such acts are shared with each youth at admission. A video on PREA is also shared with youth residing at JDC. JDC staff receive quarterly PREA training.
JDC continues ongoing monitoring to improve policies and procedures for detecting and preventing any sexual acts within JDC. The JDC review team, trained PREA investigators, PREA Coordinator, Director and all trained staff are committed to ensuring that JDC is meeting or exceeding PREA standards to ensure the safety of all youth.
